These terms apply to the supply of all SEO and related services by SEO Cairns, a trading name of Get Leads AU (ABN 82 248 614 406), unless we agree otherwise in writing. They're written to be read, not skimmed — the same way we write everything else.

Engagement and pricing

Our monthly plan pricing is published on this website and is inclusive of GST. Plans are month-to-month with no lock-in contract: you can cancel any time, effective at the end of your current billing period. Quotations for project work are valid for 30 days. Any work outside an agreed list of deliverables, undertaken without a quote, or arising from author's changes is charged at our hourly rate of $160 per hour + GST. Costs include any agreed outside expenses (for example travel, photography, stock imagery or licensed tools).

We may require payment in advance before providing goods or services. Where credit terms are agreed, invoices are due 14 days from their date, with advertising spend due in advance. We reserve the right to charge costs and expenses incurred in recovering late payments. We accept orders and instructions only on the basis that those instructing us do so as principals and are directly liable for payment.

What you own

Everything we build for you is yours. Content we write, pages we create, profiles we optimise and reports we produce belong to you once paid for — if you leave, you take it all with you. If you're comparing agencies, check this point carefully; some pursue “creative licensing” over work you've paid for. We think that if this isn't made plain to a customer, it shouldn't be allowed. You pay for the work; you should own the work.

No ranking guarantees

Search rankings are decided by algorithms nobody outside Google controls. We do not guarantee specific rankings, positions or timeframes — and consistent with Google's own guidance, we'd encourage you to treat anyone who does with suspicion. What we do commit to: specific work on specific pages, chosen from real data, reported plainly every month.

Timescales and estimates

We'll provide estimated timescales for progress and completion and use reasonable endeavours to meet them, provided you perform your obligations promptly (access, approvals, information). Quoted dates are best estimates and cannot be guaranteed. SEO results typically build over months; our published guidance on realistic timelines forms part of how we set expectations.

Cancellations and refunds

Monthly plans can be cancelled at any time and end at the close of the paid period; work already performed is not refundable. For prepaid services, we warrant a full refund where you change your mind within 14 days of payment. Where third-party costs (software licences, hosting, advertising spend) have already been rendered on your behalf, those amounts cannot be refunded once paid. Your rights under Australian Consumer Law are not affected — the ACCC's guidance on repairs, replacements and refunds applies to everything we do.

Communication

Communication needs to be through email or phone so that work, decisions and approvals can be tracked and actioned properly. We don't accept instructions via SMS or social messaging; messages sent through unauthorised channels may be missed, and contact outside approved hours may lead to review of services.

Your obligations

We provide services on the basis that you give us proper, necessary and timely instructions, authority, access and information (including execution of any required documents), and that you indemnify us accordingly. Where you instruct us to undertake a service, you're responsible for our costs in providing it whether or not it proceeds to completion. In certain circumstances we're required by law to collect evidence of identity; if requested due diligence isn't supplied, we'll be unable to provide services.

Material you supply

We accept material for publication on the basis that those submitting it are responsible for ensuring it's free from defamatory matter and doesn't infringe copyright or other third-party rights, and that those instructing us indemnify us accordingly.

Third-party contractors and services

Where possible our own staff supply and deliver our services. We may, as your agent, engage a specialist contractor for some work; we'll take reasonable care selecting and instructing them, pay their charges on your behalf and recharge them with our fees. We have limited control over third parties and accept no responsibility for their services, though where errors appear we'll go to reasonable lengths to ensure you receive what you've paid for. We can't be held liable for components of your website or campaigns reliant on third-party services you're responsible for maintaining.

Use of work for self-promotion

We reserve the right to use work we produce for the purpose of self-promotion — case studies, portfolio and examples.

Liability

To the extent permitted by law, we accept no liability for loss or damage (direct, indirect or consequential), including loss of profit or business, arising out of any single claim, event or series of related claims or events, including claims based on negligence. Nothing in these terms excludes rights that cannot be excluded under Australian Consumer Law.

Changes and jurisdiction

We may update these terms from time to time; the current version always lives at this address and is linked from our quotes and invoices. Contracts between us are concluded in English, governed by Australian law, and subject to the exclusive jurisdiction of the Australian courts.
